Terms of Service

1. Acceptance of Terms
By accessing or using the Class Gecko platform, website, or services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Class Gecko ("we", "our", or "us") provides the Service to organizations (e.g. schools, studios, activity providers) and to families and users who browse, book, or pay for classes and activities. Your use of the Service is also subject to our Privacy Policy.
2. Account and Registration
You must create an account to use certain parts of the Service. You agree to provide accurate, current, and complete information and to keep your account details and password secure. You are responsible for all activity under your account. Organizations may invite staff and manage access to their organization data. Families may register to book classes, manage enrollments, and make payments. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account, or have a parent or guardian agree to these Terms on your behalf.
3. Use of the Service
The Service allows organizations to create and manage terms (seasons), classes, camps, drop-in classes, schedules, enrollments, waitlists, trials, and payments. Families can view offerings, enroll in classes, book camps or drop-ins, and pay through the platform. You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: (a) use the Service in any way that violates applicable laws; (b) attempt to gain unauthorized access to the Service, other accounts, or our systems; (c) interfere with or disrupt the Service; (d) use the Service to send spam or malicious content; or (e) scrape, copy, or resell the Service or its content without our permission.
4. Payments and Fees
Payments for classes, camps, and other offerings may be processed through the Service using third-party payment processors (e.g. Stripe). By making a payment, you agree to the processor's terms and our billing practices. Organizations are responsible for setting their own prices, refund policies, and payment schedules. Refunds and cancellations are subject to the organization's policies and, where applicable, our refund and cancellation procedures. We may charge fees for use of the Service as described in our pricing or in a separate agreement.
5. Your Content and Data
You retain ownership of content and data you submit to the Service (e.g. class details, student information, waivers). By using the Service, you grant us a limited license to use, store, and process that content and data as necessary to provide and improve the Service. Organizations are responsible for obtaining any consents required from students, parents, or staff before submitting their data to the Service. We do not claim ownership of your content.
6. Intellectual Property
Class Gecko and its logos, design, and technology are owned by us or our licensors. You may not copy, modify, or create derivative works of the Service or our intellectual property without our written permission. You may use the Service only as permitted by these Terms.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for the conduct of organizations, families, or other users, or for the quality, safety, or legality of classes, camps, or other offerings listed on the platform. Your use of the Service is at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, Class Gecko and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars (100 USD), whichever is greater.
9. Termination
We may suspend or terminate your account or access to the Service at any time for violation of these Terms, for legal or regulatory reasons, or for any other reason we deem appropriate. You may close your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (e.g. disclaimers, limitation of liability, dispute resolution) will survive termination.
10. Changes to the Terms
We may update these Terms from time to time. We will post the updated Terms on this page and may notify you by email or through the Service when changes are material. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
11. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which Class Gecko operates, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.
